VACATION RENTAL LEASE AGREEMENT
NO DISTURBANCE: RENTER and other occupants must not annoy, endanger, inconvenience or otherwise disturb neighbors. Parties or other special events cannot be held on the premises. RENTER and other occupants must park in designated areas and not park in neighboring yards or block any neighboring driveways. The number of automobiles that can be parked is limited to the number of guests approved to occupy the Designated Rental Unit. Any RENTER found in breach of this agreement will be evicted and all rent and any security deposit will not be refunded.

RENTER agrees to rent the Assigned Rental Unit for a period commencing on ______________ (month, day, year) and ending _____________ (month, day, year).
RENTER agrees that during the time RENTER occupies the Assigned Rental Unit, RENTER shall assume full responsibility for all guests. This would include damages to the Assigned Rental Unit, including its property, building, furnishings, and rental items.
RENT: Rent is $_______ per day or $________ per week. A one-time cleaning fee of $45 and state and local taxes of 13% will be added for a total amount for your stay of $____________.
RESERVATIONS: Reservations are confirmed upon AGENT's receipt of this signed lease agreement and 50% of the total rental amount including taxes. AGENT accepts most major credit cards and/or cash and traveler's checks. Personal checks can only be accepted 30 days or more before the scheduled arrival date.
FINAL PAYMENT: The balance is due at least 30 days before your scheduled arrival date. If your balance is not received at least 30 days before your arrival, your reservation is subject to cancellation and all deposit monies forfeited. Reservations made less than 30 days prior to arrival require full payment when the reservation is taken.
SECURITY DEPOSIT: No security deposit will be charged to the guest with a credit card on file. But, the guest agrees that his/her credit card will be charged to pay any and all damage. There is a $50 penalty for failure to leave keys in the Assigned Rental Unit. Your Assigned Rental Unit is inspected before and after your rental. You are responsible for inspecting and reporting any damage in your Assigned Rental Unit.
CANCELLATIONS: In the event of termination of this Agreement, RENTER will be refunded the deposit if renter cancels more than 30 days before the scheduled arrival date. If cancellation is within 30 days of the originally scheduled arrival date, renter forfeits all deposits made in full. No refund or rent reduction is given for any reason including but not limited to weather (including hurricane warning or evacuation), staying less than the number of nights originally reserved (leaving early or arriving late), mechanical failure of any Assigned Rental Unit mechanical/electrical systems or appliances or any electronic device or service including cable. RENTER may not assign, sublet, or give the Designated Rental Unit to another party without prior consent of the AGENT.
CHECK IN/CHECK OUT: Check-in time is 3PM (est) or later. Keys will be left in your rental unit. Check-out time is strictly at 11:00 AM (est). If you have not left by check-out time, you will be charged for an additional rental day.
MAXIMUM OCCUPANCY: Occupancy is restricted to _____________ adults or children over 7 years of age. Additional guests or visitors must be approved by the AGENT in advance. Any RENTER found in breach of this agreement will be evicted and all rent and any security deposit will not be refunded.
SMOKING: Smoking is not permitted in the Designated Rental Unit. If smoking is detected, the RENTER will be charged an additional cleaning fee of $150.
MAINTENANCE: AGENT cannot guarantee all mechanical or electrical systems, appliances, electronic or cable service will be fully functional 100% of the time. Upon report of any problem, AGENT will make any reasonable effort to have repairs quickly made. An authorized employee or repairman may enter the premises during business hours for purposes connected with repairs, care, or maintenance of the premises.
FORCE MAJEURE: No Party shall be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, government regulations, disaster, civil disorder, curtailment of transportation facilities, interruption of electricity or any other emergency making it inadvisable, illegal, or impossible to provide the Designated Rental Unit. NO REFUND will be offered in these situations.
PETS: Pets are permitted WITH PRIOR APPROVAL in or on the Designated Rental Unit property. AGENT reserves the right to refuse to allow a pet not previously approved due to size or other considerations. RENTER found in breach of this agreement will be evicted and all rent and any security deposit will not be refunded. Any pet damages will be your financial respons
HOUSEKEEPING: An initial supply of bed linens, bath towels, bath soap, toilet paper, trash bags and paper towels will be supplied based on the occupancy of your Designated Rental Unit. Other essentials will not be replenished and housekeeping services are not provided.
RENTAL UNIT REASSIGNMENT: For reasons beyond AGENT's control, RENTER may be assigned another comparable unit or an upgraded unit at no additional cost with no liability to the AGENT. AGENT will make a courtesy call to the RENTER and inform him of the situation but rent and any security deposit will not be refunded.
CREDIT CARD: RENTER agrees and accepts all liability for rent, deposits, and other fees itemized in the Agreement. RENTER also acknowledges liability and agrees to pay for any damages beyond reasonable wear and tear. RENTER agrees that unless another form of payment is provided, these expenses will be charged to the RENTER's credit card on file.
INDEMNIFICATION: RENTER shall save the AGENT and property owner harmless against any breach by RENTER of the terms, conditions, undertakings and representations contained in this Agreement; any liability or loss (including legal costs on a full indemnity basis) arising from RENTER's or RENTER's guests during possession and use of the Designated Rental Unit, including injury, death, physical damage or loss to persons or property; and any costs and expenses incurred by AGENT or OWNER in enforcing this Agreement or protecting AGENT and OWNER rights and interests under this Agreement.
MISCELLANEOUS
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia without regard to the conflict of law principles thereof. The parties hereby agree to submit to the jurisdiction of the courts of the State of Georgia for the purpose of resolving any dispute arising out of or resulting from this Agreement.
No Waiver: The waiver of any breach of this Agreement either by RENTER or AGENT of any rights, remedies or defenses is not intended and will not be deemed a waiver of any additional rights, remedies or defenses to which such party would be entitled at law or in equity as to such breach. In addition, no waiver by either party of a breach of any term or provision of this Agreement will be construed to be a waiver of any proceeding or succeeding of the same or any other term or provision.
Saving Clause: The parties intend that the covenants herein shall be deemed to be a series of separate covenants, and in the event that in a judicial proceeding, or a court shall refuse any such covenants, then such unenforceable covenants shall be deemed eliminated from the provisions hereof for the purpose of such proceedings to the extent necessary to permit the remaining separate covenants to be enforced in such proceedings.
Headings: The headings to the Section of this Agreement are for convenience only and shall not be considered a part of this Agreement or be used in determining the intent of the parties.
Modifications or Extensions: Except as otherwise provided herein, this Agreement may only be modified or extended by a written agreement signed by both parties.
ENTIRE AGREEMENT: This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof, supersedes all previous written or verbal agreements between the parties, including but not limited to all representations, warranties, statements, correspondence, and understandings previously made by AGENT or RENTER with respect to the subject matter of this Agreement.
